Shakira has to appear in court in Barcelona today. The singer is accused of tax evasion, which puts her at risk of a prison sentence of eight years and a fine of more than 23 million euros.
Justitie beschuldigt Shakira van gesjoemel met verblijfplaatsen en ondernemingen om op grote schaal inkomstenbelasting te ontduiken. Het gaat om zes strafbare feiten die gepleegd zouden zijn tussen 2012 en 2014.
De zangeres zou 14,5 miljoen euro moeten betalen over haar inkomsten in de periode van 2012 tot en met 2014. De Spaanse Belastingdienst zegt dat ze verplicht is dit af te dragen als ze 183 of meer dagen in het land heeft doorgebracht.
De 46-jarige artiest meent dat ze niets verkeerd heeft gedaan: ze heeft naar eigen zeggen destijds niet in Spanje gewoond. Ze kan er dus geen inkomstenbelasting verschuldigd zijn.
Shakira’s advocaten zeggen dat hun cliënt op de Bahama’s woonde en pas in 2015 naar Spanje is verhuisd. Ze heeft in de betreffende periode wel ruim 10 miljoen dollar (9,6 miljoen euro) aan belasting betaald aan de Amerikaanse belastingdienst.
Shakira spreekt van een lastercampagne. Zij vindt dat haar recht op privacy met deze zaak is geschonden. Ze zegt bewijs te hebben dat ze niet veel in Spanje was, wat haar zou vrijwaren van het betalen van belasting.
De Spaanse justitie stelt dat ze van 2012 tot 2014 geen dag in haar huis op de Bahama’s is geweest. Ze zou Spanje alleen hebben verlaten voor de opnames van de Amerikaanse The Voice.
Last year, the singer received a settlement offer for an undisclosed amount, but she refused. If Shakira is indeed found guilty, she could receive a prison sentence of eight years. Justice is also demanding a fine of more than 23 million euros.
According to Spanish media, the singer has now paid the money that the service demands; 14.5 million euros in overdue tax money and 3 million euros in interest. As a result, any sentence will likely be much lower than prosecutors are seeking.
Last summer, Spanish justice again charged Shakira with tax fraud. The singer allegedly did not complete her 2018 tax return truthfully. She then allegedly evaded 6.6 million euros in taxes. The artist is said to have used a company on the Amsterdam Zuidas to do this.
According to it F.D the singer used several letterbox companies: companies in countries with favorable tax rules that are actually no more than a postal address. One of them is located in Amsterdam.
Shakira is originally from Colombia, but moved to Spain because of her ex-partner Gerard Piqué. The footballer played for FC Barcelona and the two lived together in the Spanish city with their two children. The couple separated last summer.
