From a few meters away, he tried to shoot twice, but the gun malfunctioned. The court sentenced a 25-year-old Nijmegen resident on Friday to a prison term of three years for attempted manslaughter and drug possession.

It happened on February 25 last year in the Hatert district. The pair already had a history together. The Nijmegen resident had previously reported a stabbing and the other had already served a prison sentence for it.

The Nijmegen resident said at the criminal hearing two weeks ago that he did not remember much about that day. It was a long time ago and he wanted to forget it, he said. After his arrest, he told the police that the man ‘with whom I have a past’ was the one who had a gun and tried to rob him.

Visit to the hairdresser

The victim stated otherwise. “He came at me with a gun in his hand. Less than a meter away he continued to charge and wanted to shoot,” he says. ‘It did not work. But I saw him pull the sled back.”

The man said that the Nijmegen resident had followed him to his grandmother in Hatert after a visit to the hairdresser. A fight broke out in the street. After it failed the first time, the Nijmegen resident pointed the gun at him again. ‘He wanted to click, but it didn’t happen. Then he ran away.’

A neighbor looked out the window, saw the fighters land on the hood of his car and approached them. Immediately after the incident, he told the police that he had seen the Nijmegen resident take a gun from a bag and point it at the other person. He did not see whether the man pulled the trigger, but he did see that moments later he pointed the gun at the ground to continue loading. That didn’t work, after which he saw the Nijmegen resident running away.

A bullet

A few days later the neighbor wanted to withdraw his statement. He said he didn’t remember what happened and didn’t remember seeing a gun.

The victim’s father, who was with his grandmother that day, says his son came in upset and said the Nijmegen resident tried to shoot him. The son showed a bullet that had fallen from the firearm.

The father stated that the Nijmegen resident had previously threatened that he would ‘shoot his son to pieces’ as soon as he was released. The father and another son had gone after the Nijmegen resident. They had heard him say: ‘All three of you are going to die.’

They had also seen him throw a bag on a roof. It later turned out to contain cocaine and heroin. The Nijmegen resident denied that it was his.

He messaged a friend of his shortly before that he was walking ‘towards grandma’. “Come this way, I’m getting arrested,” he further wrote.

Wrong people

After the incident, the Nijmegen resident was in pre-trial detention for a week and was then released conditionally. He already had a criminal record. The probation service is concerned. The Nijmegen resident lives on social assistance benefits, does not have good daytime activities and hangs out with ‘the wrong people’. He developed emotional problems at a young age and is mentally retarded.

The Nijmegen resident said that he is willing to undergo behavioral training and be guided. But the court agrees with the public prosecutor that he should first go to jail.
