Philips settlement may also have significance in the Netherlands

AMERSFOORT (ANP) – Philips’ settlement of 1.1 billion dollars for Americans who say they have been damaged by this company’s devices against apnea, could also become significant in the Netherlands. After all, Philips sees “that something has gone wrong”, says Dutch lawyer Mark de Hek of SAP Personal Injury Lawyers. The arrangement could therefore possibly work to the advantage of the more than a thousand Dutch people represented by De Hek who also report complaints about this equipment or are concerned about the possible consequences of its use.

His clients, their supporters and he are still waiting for the results of investigations by Philips to determine what the next step should be. These results are first checked by the American FDA inspection and by specialists hired by SAP itself. This mainly concerns additional studies, after the FDA did not consider previous findings by Philips itself to be adequate enough, according to De Hek.

It is not clear when the information can be expected. It will then be examined whether the company can be held liable and, if so, whether a settlement is possible here or whether a lawsuit will still have to be filed.
