A 43-year-old security guard from Deurne had sex with a detainee in Ter Peel women’s prison in Evertsoord in Limburg. However, he will not be punished for this, as it turned out in the court in Maastricht on Tuesday. He is said to have crossed the line when he worked as a security guard in prison, but the court finds indecency not proven, L1 reports.

It is clear that the two had sex with each other several times in 2022 and last year. This mainly happened in the woman’s cell.

According to the judge, the sexual contacts were voluntary and the woman took the initiative. She also never filed a report herself. Investigation has shown that the security guard, who has since been fired, and the woman were initially flirting and that this turned into something more. There was no question of fornication, the judge ruled.

‘Sex in prison is not allowed’
The Public Prosecution Service (OM) had a completely different view and previously demanded a community service order of two hundred hours and a suspended prison sentence of three months for the man. The public prosecutor spoke clearly during the hearing two weeks ago: “Sex in prison is not allowed. At least not between a security guard and a detainee. Not even with mutual consent. The law is clear about this, to protect the vulnerable party, the detainee, who is, after all, in a relationship of dependence on the security guard.”

The judge does not agree with this: “The relationship of dependency did not play a role in the sexual contacts.” The Public Prosecution Service has two weeks to appeal.
