Algerians awaiting deportation to their country of origin may be temporarily detained again. According to the Council of State, this is allowed because the Algerian authorities want to cooperate again in these types of deportations.

If an asylum seeker has been told that he or she will not receive a residence permit, this person must leave the Netherlands. Someone can leave voluntarily or be forced to. In the latter case, a person may be locked up in a special prison until it is time to leave.

The ruling of the Council of State makes it possible again after two years to temporarily detain Algerians pending their departure. Because in order for that departure to take place, the country of origin must cooperate and issue special travel documents. Algeria did not do that for a long time.

For example, last year the Netherlands applied for a total of 141 of these types of special travel documents. Algeria did not issue it until the end of the year. In October and December, some so-called laissez-passer (a free pass to cross the border, ed.) were issued.

As a result, according to the high court, the Netherlands can once again assume that Algerians will be deported within a “reasonable period”.
