TikTok will file a complaint with an American court against the law that leads to a possible ban of the popular video app in the United States. A spokesperson reported this on Wednesday.

The United States Senate on Tuesday approved a $95 billion aid package for Ukraine, which will be signed by US President Joe Biden on Wednesday. The measures against TikTok are part of that package.

That package includes an ultimatum for TikTok to cut ties with China. In concrete terms, Chinese parent company ByteDance must sell the app within twelve months to avoid being banned from the Apple and Google app stores in the US.

TikTok “fundamentally disagrees” with the law, the spokesperson said. According to him, former President Donald Trump previously tried to ban TikTok, but a court blocked that. “The only route we see is to go to court and challenge it there,” he says.

TikTok has 170 million users in the US, including influencers who make money from the app. They risk losing their income if TikTok is banned. For that reason, the video app has put forward economic arguments against the law. The company states that creators and traders who sell goods through the platform would be disadvantaged.

“TikTok’s unique business model allows companies to showcase products and services in a creative way,” said Damian Rollin of SOCi, a platform that helps entrepreneurs manage their digital business operations.

The Americans believe that China uses the platform for propaganda and could misuse American user data. According to the spokesperson, the fact that TikTok is a channel for Chinese propaganda is “completely unproven”. Users post the videos, not TikTok or governments, he says. The spokesperson states that the video app keeps users’ data as safe as possible.
