No real contract

Bas and Nicolette state that they have agreed verbally and via WhatsApp with a Coca-Cola manager that they would receive 2.6 million euros for promotional activities at five festivals in 2023. Nice work if you can get itwe then sing.

Everyone wants money from each other

600,000 euros have already been paid to Smit and Van Dam via an intermediary company. It is now demanding its money back from the couple. And Nicolette and Bas still want the rest of those 2.6 million euros ‘because they adjusted their spending pattern to their income and hired an au pair.’

The American company suspects that there has been collusion with the employee – who has since been dismissed – with whom the agreement was made. The trio are also said to have ties with each other in private. Smit and Van Dam deny that.

‘In good faith’

They say they were ‘completely in good faith’ in entering into the agreement. They therefore still demand payment of 2 million euros from the soft drink maker, and do not want to repay the 600,000 euros already received.

According to their spokesperson, the fact that the extremely lucrative deal with Coca-Cola was not based on a signed contract, but only verbal agreements, apps, e-mails and presentations, and that it involved high payments for sometimes unclear services, would not be unusual. in the world of influencer marketing.

‘Business contact’

They also deny being friends with the marketing manager. “They live near each other and meet each other in the schoolyard, but they did not visit each other,” said the spokesperson. “It was a friendly, but businesslike contact.”

Reputations at stake

Smit and Van Dam emphasize that they have requested a witness hearing in court to get to the bottom of the matter. “They would not do that if they were in bad faith,” their spokesperson said. “The witness hearing will show that they cannot be blamed and that they are entitled to the payment of 2 million. But more importantly, their reputation remains intact.”
