The judges of the court in Leeuwarden have been criticized because a ruling in the case known as the ‘Marum swimming pool murder’ was published too early. It concerns the punishment for Johan L., the man who allegedly supplied the murder weapon.

The lawyers of Monique H., Marcel H. and Coby van der L. have all submitted a recusal investigation. According to the counsel, the premature publication of the judgment shows bias on the part of the court.

Wilko ten Have, Monique H.’s lawyer, says she is very surprised by the turn of events.

The challenge is primarily a point of principle. The judgment was to be read at 1:30 PM, but in the case of Johan L. it was already online at Rechtspraak.nl at 11:00 AM. This was discovered by journalists from the Dagblad van het Noorden.

The journalists pointed out the error to the court, after which the judgment was taken offline again. Sander Dekker from it Dagblad van het Noorden states that they have not published the contents of the judgment as a matter of principle so as not to disrupt legal proceedings.

An explanation of the request for recusal will be given at 1:30 p.m. The court itself can choose to resign. Otherwise, a recusal chamber will meet. The consequences for the verdict scheduled for this afternoon are unclear.
