The court in Breda has given a driver from Roosendaal four years in prison for causing a fatal traffic accident in Oud Gastel in North Brabant in 2022. The Public Prosecution Service (OM) had demanded eight years in prison.

On September 2, 2022, Omar E. collided with a car with six occupants at a speed of 95 kilometers per hour. Four people died. According to the court, the 28-year-old Roosendaler drove recklessly.

The accident happened on the Roosendaalsebaan in Oud Gastel. The victims were a mother (39), her son (8), her daughter (10) and another passenger, a 42-year-old woman. Her nine-year-old daughter survived the accident, but was injured. E.’s car rammed the Toyota they were in at a speed of 95 kilometers per hour when it came out of a side street. The permitted speed was 50 kilometers per hour.

“Their vehicle was swept away with the force of a tank,” the prosecutor said earlier. The suspect himself and his two passengers were unharmed.

The suspect was driving 155 kilometers per hour during the crash

Just before the crash, E. was driving at a speed of 155 kilometers per hour. The suspect was driving on a major road, where the traffic lights were not working at the time and were flashing orange. According to the court, however, other road users did not have to be aware that someone would approach at such a high speed and the driver of the Toyota complied with the rules. “They had no way of anticipating his behavior.”

The defense believed that E. could trust that he would be given priority. The fast driving would have been an attempt to pass the Toyota and thus resolve the situation. The court ignores that. According to the judge, he caused the situation himself.

The man had already been convicted for bad driving

Even though the officer also spoke of reckless driving, the imposed penalty is much lower than the requirement. This is because the Public Prosecution Service assumed two criminal offences, namely causing the collision that resulted in four deaths and the collision in which someone was injured. According to the court, this is unjustified, because there would only have been one act and event.

In addition to the prison sentence, the court imposed a driving ban on E. for ten years. He has previously been convicted of traffic offences. According to the court, he appears “not to want to learn from his mistakes” and has not taken responsibility for the accident.
