The court finds that the suspect has made a number of serious traffic errors and that he is guilty of causing a fatal traffic accident and (serious) injuries. The suspect had too much to drink, drove too fast and did not slow down when approaching the group of cyclists. He then hit the cyclists and continued driving.

The suspect was therefore guilty of very careless and inattentive driving behavior. As a result of his behavior, someone died and 3 other people suffered (partly) serious injuries. The suspect has caused deep and irreparable suffering to the surviving relatives and the victims.

The court realizes that in cases such as these it is impossible to impose a sentence that meets the feelings of the surviving relatives and the victims. No punishment will take away the enormous sadness over the loss of their loved one. But the court must also impose a sentence that is appropriate to the accusation that can be made against the suspect, without losing sight of the fact that the suspect never wanted the consequences of his (highly culpable) driving behavior and that this also has major consequences for him. have consequences. The court finds a prison sentence of 3 years and 9 months appropriate. After serving his prison sentence, the suspect may not drive a vehicle for 5 years, minus the time he lost his driver’s license after the accident.
