The recent accusation against Tommy Lee appears not to be enough for a lawsuit for the time being. The American drummer was accused of sexual misconduct in December. An American judge now rules that information is missing, reports NME Tuesday.

The alleged victim, who has been identified anonymously, was allegedly abused by Lee during a helicopter flight in 2003. Details about the incident itself appear to be insufficient.

Older cases must meet certain criteria, US law states. It is necessary to demonstrate that the incident was deliberately concealed.

According to Lee’s lawyer, that is not possible. The indictment states that Lee was already known for his lecherous behavior. In that case it would be impossible to cover up the matter.

If the woman wants to proceed with the case, she must provide additional evidence within 20 days.

‘Fears and depression after helicopter incident’

According to the woman, the helicopter pilot and Lee drank alcohol, smoked weed and used cocaine during the flight. Then the drummer of Mötley Cruë forced himself on the woman.

Lee allegedly groped her, kissed her and fingered her. The musician also pulled down his pants and tried to push the woman’s head towards his genitals.

In court documents, the woman says she didn’t go to the police because she didn’t think she would be taken seriously. The woman says that since the alleged incident she has suffered from anxiety and depression, among other things. She is seeking unspecified damages from the artist.
