Lawyer Kerem Canatan, specialized in international criminal law and extraditions, expects that he will be extradited to the Netherlands this year. The footballer is currently stuck in Dubai at the request of the Netherlands. Thursday is the first day of the extradition process for the Amsterdammer in Dubai.

Promes has now been detained in Dubai at the request of the Netherlands for a month and a half and has appealed against the extradition. That process will start next Thursday, after which it will become clear whether the winger will be extradited to the Netherlands or to Russia. In Russia, the footballer is also said to be on the wanted list for tax evasion.

AT5 listed the facts and mapped out how realistic the chances are that Promes will soon be in the Netherlands. “The extradition judge in Dubai does not look at the convictions, because Promes has appealed against his convictions. So they only look at the facts he is suspected of and whether it carries at least a year in prison,” Canatan explains. This is the case at Promes, so they then assess whether there are reasons to refuse extradition.

“For example, they may say that the Netherlands has not sent the correct paperwork or that it has not been submitted correctly. Other grounds for refusal are, for example, if it concerns a political offense or if someone could receive the death penalty. Or if it would not constitute a criminal offense in the country itself. This is then argued by the lawyers and the judge must then assess whether those grounds for refusal apply,” said the lawyer.

Canatan predicts that Promes will be extradited to the Netherlands this year. “Normally you are extradited after the extradition decision, but there is normally still an appeal option. But I expect that – if the extradition is allowed – he will be in the Netherlands this year.”
